And there being did make an assault; And that the said Sam Jones otherwise called Hunter then and there feloniously, willfully and of his malice afore thought the said Robert Herron did chase, drive, push cast and throw into a certain creek then and there situate, wherein there was a great quantity of water, and that he the said Sam Jones otherwise called Hunter in and with a certain boat then and there lying and being chased and pursued him the said Robert Herron and overtook him the said Robert Herron was in the said Creek whilst he the said Robert was in the said creek swimming in water beyond his depth, and that he the said Sam Jones otherwise called Hunter him the said Robert Herron in the said creek swimming as aforesaid and overtaken as aforesaid with a certain paddle of the value of the cents which he the said Sam Jones otherwise called Hunter in his right hand then and there had and held in and upon the head, breast, back, shoulders and arms of him the said Robert Herron then and there feloniously, wickedly, willfully and of his malice aforethought did strike and thirst, by which said striking and thrusting he the said Robert Herron was then and there so bruised, stunned, wounded and disabled that he the said Robert Herron then and there in the water of the creek aforesaid in which he was swimming as aforesaid instantly sunk and went down and he the said Robert Herron in the creek aforesaid with the water aforesaid was then and there choked, suffocated and drowned, of which said choking, suffocation and drowning he the said Robert Herron then and there instantly died. And the Jurors aforesaid upon their oaths aforesaid do further present, that Caesar (where other name if he hath one and whether the same be his Christian or surname or whether he hath another name is to the Jurors unknown) late of said County a negro slave on the day and year aforesaid in the
