as an overseer was appointed and requested by the said Bryan Croom for him and in his name and stead to dispose of and sell a certain horse being then and there the property of the said Bryan Croom, wherefrom in pursuance of the authority so given to the said John Oliver by the said Bryan Croom he the said John Oliver afterwards to wit on the first day of January 1838 sold said horse to one John Shaw for the sum of one hundred and fifty dollars lawful money which said sum of money so received as aforesaid from the said John Shaw on the purchase money for said horse he the said John Oliver then and there paid to the said Bryan Croom at the special instance and request of said Bryan Croom and the plaintiff further avers that afterwards to wit on the 26[th] day of June 1838 and after the death of said John Oliver the said John Shaw to whom the said John Oliver as agent for the said Bryan Croom had sold said horse instituted a suit in the County court of the County of Gadsden in said Territory against the plaintiff as administrator alleging in the declaration filed in said suit that the aforesaid horse was unsound at the time of the aforesaid sale by the said sale by the said John Oliver to him the said John Shaw and at the term of said Court held at the town of Quincy in said County on the 22[nd] day of January 1840, he the said John Shaw received a judgment in said suit against the plaintiff as administrator as aforesaid for the sum of one hundred and fifty two Dollars and ten cents the damages sustained by the said John Shaw on account of the unsoundness of said horse together with the sum of twenty five dollars the costs by him the said John Shaw expended in and about the said suit, all of which sum of money so
